This matter is being taken up for hearing through video conferencing due to the outbreak of pandemic, COVID-19. The petitioners pray for a direction to the respondents to re-fix their pay in accordance with notification dated 01.12.2011 (Annexure P-5) in view of decision dated 22.10.2013 in CWP-25733-2012 (Annexure P-7) and decision dated 30.09.2016 in CWP-2866-2014 and connected writ petitions (Annexure P-8) as well as instructions dated 04.07.2019 (Annexure P-12).
Learned counsel for the petitioner submits that legal notice dated 25.09.2020 (Annexure P-14), in this respect has been submitted by the petitioners, but no action is being taken by the authorities. SUNIL 2020.12.08 12:01 I attest to the accuracy and authenticity of this document
CWP-20975-2020 -2At this stage, learned counsel for the petitioners restricts his prayer for a decision on legal notice dated 25.09.2020 (Annexure P-14), in a time bound manner. It is also submitted that the petitioners also restrict their claim to the arrears, if any, to a period of 38 months from the date of submission of their legal notice.
Keeping in view the facts and circumstances of this case, but without any expression of opinion on the merits of the matter, this petition is disposed of with a direction to the competent authority to decide legal notice dated 25.09.2020 (Annexure P-14), by passing a speaking order, within a period of three months from receipt of certified copy of this order. Petition is disposed of accordingly.
