JASWANT SINGH, J. (ORAL) The petitioner applied in the General Category for the appointment to the post of Constable in the District Police Cadre, Punjab, pursuant to the Advertisement dated 31.5.2016 (Annexure P1). The petitioner claims that in the selection process, he had secured 29 marks and was allotted the District Ludhiana, for appointment as a Constable. Since he was not being offered appointment, he filed CWP No.27082 of 2016, which was disposed of vide order dated 23.12.2016, with a direction to the authorities concerned to decide his claim for appointment.

CWP-28352-2018 (O&M) 23.6.2017, (Annexure P7), stands passed whereby it is stated that the actual merit of the petitioner was determined as 28 marks instead of 29 marks, in view of the petitioner having incorrectly stated in his online application form with regard to the percentage of marks secured by him in his 10 + 2 Exam. The petitioner had wrongly stated that he secured 70.7% marks and therefore, was awarded 29 marks whereas factually he has secured 66.3% marks reducing the awarded marks to 28. Based on such selection on merit, the petitioner did not fall within the zone of appointment. After arguing for sometime and having failed to convince this Court, counsel for the petitioner prays for permission to withdraw the instant petition.

Dismissed as withdrawn.
