***** VINOD S. BHARDWAJ, J. (Oral) Challenge in the present petition is to the order dated 25.05.2026 passed by Civil Judge (Senior Division), Ambala in Civil Suit No. 671 of 2026 under Order 39 Rule 1 and 2 of Code of Civil Procedure, 1908.

Learned Counsel appearing on behalf of the petitioner has been confronted with the provision as contained under Order 43 Rule 1 CPC which prescribes that an order passed by the Court under Order 39 Rule 1 and 2 of Code of Civil Procedure, 1908 is appealable before the Court of District Judge.

Under the said circumstances, remedy of statutory appeal before the Court of District Judge is available to the petitioner. Faced with the above, Counsel for the petitioner seeks withdrawal of the present petition so as to approach the Court of District Judge.
