COCP-2718-2020 Ram Kumar vs Anurag Rastogi and others Date of Decision: 16.03.2021 CORAM: HON'BLE MR. JUSTICE HARINDER SINGH SIDHU
Present:
Mr. S.K.Malik, Advocate for the petitioner.
Mr. Tapan Kumar, DAG, Haryana.
HARINDER SINGH SIDHU, J Reply on behalf of the respondent-State has been circulated on the e-mail wherein it is stated that in compliance of the order, separate speaking orders with respect to claim of each of the petitioners have been passed vide which past service of the petitioners has been counted and their pension has been revised besides releasing leave encashment and gratuity of the petitioner(s) as per their entitlement.
Learned counsel for the petitioner(s) states that interest on the delayed payment has not been released to the petitioner(s). Since the direction was issued to decide the legal notice and pass speaking order thereon, admittedly the order has been complied with. In view thereof, both the petitions are disposed of as having become infructuous. However, it would be open to the petitioner(s) to take recourse to any appropriate remedy with respect to claim of interest on delayed payment, if any.
