MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking release of his passport and permission to travel abroad in case No.CHI-108-2023 in FIR No.RC/DST/2019/S00010 dated 01.11.2019 registered at Police Station STB, New Delhi under Sections 406/420/468/471/120-B of the IPC. 2.
Learned counsel for CBI has at the outset submitted that the petitioner had approached this Court being aggrieved by the order dated 12.06.2023 passed by learned Special Judicial Magistrate, CBI, Punjab, S.A.S. Nagar, vide which his prayer for permission to travel abroad from 10.05.2023 to 08.07.2023 had been declined and, therefore, his prayer has since been rendered infructuous. 3.
Learned counsel for the petitioner submits that in the above circumstances, he restricts his prayer only for release of his passport for the purpose of updation. He submits that in compliance of order dated 03.06.2023 passed by learned trial Court, when he was enlarged on bail; he had deposited his passport before the trial Court. CRM-M-41786-2023 -2expired on 10.12.2020 after which he solemnized second marriage, for which updation is required in his passport.

At this stage, learned counsel for the CBI has apprised this Court that neither was this ground raised before the learned trial Court nor had the petitioner approached an appropriate forum for the purpose of updation of his passport.

Learned counsel for the petitioner submits that he would be approaching an appropriate forum for the relief, as prayed for. 6.
In the facts and circumstances, no ground is made out to accept the prayer made in the instant petition. The same, therefore, stands dismissed.
