**** HARSIMRAN SINGH SETHI , J. (ORAL) Present writ petition has been filed by the petitioner in which he has challenged the order/letter dated 05.10.2018 (Annexure P-6) by which his request for withdrawal of the resignation dated 12.07.2018 (Annexure P-3) has been rejected.
Counsel for the petitioner contends that the respondents are under obligation to consider the request of the petitioner for the withdrawal of the resignation as per Clause 7.5(4) of the Punjab Civil Services Rules. In this regard, the petitioner also relied upon a decision of Division Bench of this Court, rendered in CWP No.2120 of 1986 titled 'Bawa Singh Vs. The State of Punjab and others, decided on 02.01.1989.

CWP-28399-2018 -2Counsel for the petitioner further states that he will be satisfied if a direction is given to the respondents to consider the legal notice given by the petitioner dated 17.10.2018 (Annexure P-7) and pass the appropriate orders on the same within a time frame. Keeping in view the request made by counsel for the petitioner, the present writ petition is disposed of with a direction to the competent authority to consider the Annexure P-7 i.e. legal notice and pass the appropriate orders on the same, within a period of three months from the date of receipt of certified copy of this order. However, it is made clear that this Court express no opinion on the merits of the case. Present writ petition stands disposed of.
