RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.

Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner in a case arising from FIR No.85 dated 12.04.2019 registered under Sections 22 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Lehra, District Sangrur.

According to prosecution, petitioner is facing trial under Sections 22 and 25 of the NDPS Act for keeping in conscious possession 1500 tablets of Tramadol Hydrochloride and 3600 tablets of Alprasafe, which are prohibited drugs, falling under the category of "commercial quantity", without any permit or license.

Learned counsel inter alia contends that petitioner is in custody RAVINDER SINGH 2020.08.11 16:34 I attest to the accuracy and integrity of this document

-2CRM-M-34856 of 2019 (O&M) since 12.04.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Having given thoughtful consideration to the rival submissions, this Court is not inclined to grant regular bail to the petitioner, considering recovery of huge quantity of prohibited drugs from the conscious possession of the petitioner.

Dismissed.

At this stage, learned counsel for the petitioner prays for withdrawal of this petition.
