This petition is filed for grant of regular bail in FIR No. 599, dated 28th August, 2020, under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station City, Rohtak (Haryana).

The police on 28th August, 2020, acting on a secret information, apprehended the petitioner, namely, Munny @ Sunny, and recovered 14 bottles of WIN CEREX 100 Ml. each containing Codeine Phosphate. 4.

Learned counsel for the petitioner submits that incomplete challan was filed without the FSL report. He relies upon the decision of this Court in Suresh v. State of Haryana (CRR No. 1135 of 2020, decided on 18.11.2020).

From the perusal of the impugned order, it is not forthcoming that the plea raised now by the learned counsel for the petitioner, was raised before the Sessions Court.

Accordingly, the present petition is disposed of with liberty to the petitioner to approach the Sessions Court for bail on the ground of filing of incomplete challan.
