Learned State counsel, on instructions from ASI Sukhdev Singh, submits that pursuant to the order dated 8.9.2022, the petitioner has joined the investigation, though certain articles of dowry are yet to be recovered. A perusal of the FIR shows that there is not even an allegation of specific entrustment of alleged dowry articles to the petitioner's family. Even otherwise, these facts are matter of trial and the Investigating Agency cannot be allowed the custodial interrogation of the petitioner on that account. In view thereof, the petition is allowed. Interim order dated 8.9.2022, passed by this Court, is made absolute.
