The present petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of writ in the nature of Mandamus for directing respondent No.2 (Deputy Commissioner, Panchkula) to remove respondent No.5 (Sukhjinder Kaur) from the post of Sarpanch as she is alleged to be in an illegal position of the Panchayat land, which is a disqualification under Section 175 (n) of the Haryana Panchayati Raj Act, 1994.

Learned counsel for the petitioner submits that on a complaint filed by the petitioner, the Deputy Commissioner, Panchkula has already initiated action and that inquiry stands marked to the learned Sub Divisional Officer, Kalka, District Panchkula. Ms. Upasana Dhawan, AAG, Haryana, who has appeared on behalf of respondent/State in this case, pursuant to the advance copy of petition having been sent to the State, on instructions of Mr. Rajan Singla, DDPO, Panchkula, submits that since the proceedings are already pending consideration before the Deputy Commissioner, Panchkula, an earnest effort would be made to conclude the proceedings within a period of three months from today.

In view of the statement made by learned State counsel, learned counsel for the petitioner submits that he does not press the instant petition any further.

In view of the aforesaid submissions made by the respective counsel, the petition is disposed of, accordingly. 6.
