SANDEEP MOUDGIL, J (ORAL) Prayer in the instant application filed under Section 528 of BNSS of 2023 is for issuance of directions to respondent Nos.1 to 3 to conduct fair and impartial investigation and file challan report under Section 193 BNSS within a stipulated period in case FIR No.59 dated 05.04.2024 under Sections 420,406,408,120-B IPC registered at P.S Guruharsahai, District Ferozepur. Learned State counsel, on instructions from ASI Naresh Kumar, submits that a cancellation report stands presented to the competent court and therefore nothing survives in the present petition. Faced with the situation, learned counsel does not want to press the petition and prays for withdrawal of the same. Prayer is accepted.
