Learned senior counsel appearing on behalf of the petitioner has contended that the present petition has been filed challenging the proceedings under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961 (for short the 'Act of 1961'), however, prior to the order issuing notice of motion, the possession was taken on 08.09.2022. Learned senior counsel has further contended that a petition has been filed on 16.08.2022 under Section 11 of the Act of 1961 which is pending before the Additional Deputy Commissioner Development, Hoshiarpur exercising the powers of Collector under Section 11 of the Act of 1961. Learned senior counsel states that he be permitted to withdraw the present petition with liberty to pursue the petition filed under Section 11 of the Act of 1961. CWP-20647-2022 -2may be directed to be decided in a time-bound manner as the petition under Section 7 of the Act of 1961 itself was not decided in accordance with law. Since possession already stands taken, he wishes to pursue the petition filed under Section 11 of the Act of 1961.

Learned State counsel on instructions from Sh. Dilpreet Singh, Block Development and Panchayat Officer, Bhunga states that the petition under Section 11 of the Act of 1961 would be decided within a period of three months from today.

In view of the above, the present petition is disposed off as not pressed. However, the petition filed under Section 11 of the Act of 1961, which is pending before the Additional Deputy Commissioner, Developmentcum-Collector, Hoshiarpur for 01.06.2026, be decided expeditiously and preferably within a period of three months from today. Pending applications, if any, also stand disposed off.
