******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 50 dated 13.05.2019 registered for the offences punishable under Section 306 of Indian Penal Code (for short IPC) at Police Station Chhajli, District Sangrur.

Heard.

Notice of motion.

On asking of the court, Mr. Avtar Singh Sandhu, Addl. A.G., Punjab, who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with her. As per case of the prosecution, deceased-Mani Singh was having relations with Arshdeep Kaur and had gone to the house of Gurdeep Singh with her. CRM-M-35199-2019 -2Navpreet Singh @ Navi. Both searched for Mani Singh and gave him thrashing at bus stand Chatha. Thereafter, they brought him to their house and again gave him beatings. Feeling insulted, Mani Singh committed suicide by hanging with a fan.

Learned State counsel submits that police during investigation recorded the statements of eye witnesses, who had seen the petitioner and co-accused giving beatings to the deceased at bus stand for meeting Arshdeep Kaur. Immediately, before the incident, they have again given beatings to him at their residence. Though, there is no post-mortem conducted on the body of deceased but there is direct evidence that he committed suicide.

At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition.

Dismissed as withdrawn.
