The applications are allowed and the applicants mentioned above are impleaded as party to the petitions i.e CWP No. 3149, 9005 andc 3155 of 2017. Amended memo of party is taken on record. CWP No. 3137-2017 and connected matters.
Petitioners are seeking direction to respondent No. 3 to consider the petitioner eligible for the post, as the result of the petitioner was confidentially conveyed by the University before the last date of submission of the application i.e 21.09.2015.
The question for consideration in the writ petitions are whether the confidential result communicated by the University to the third respondent-Haryana Staff Selection Commission could be treated as petitioner is qualified as on the last date or not. This Court granted interim relief to the petitioners and respondents were directed to interview the petitioners provisionally. This issue has already been decided by this Court in CWP No. 27021-2016 titled as Priyanka and others vs. State of Haryana and others, decided on 23.10.2017 and LPA against the judgment dated 23.10.2017 has also been dismissed by this Court, vide LPA No. 362-2018 titled as Haryana Staff Selection Commission vs. Priyanka and others. This Court has held that the Haryana Staff Selection Commission has to take the candidate eligible whose confidential result has been communicated by the University to them before the cut off date i.e 21.09.2015.
In view of the above position, the above petitions are disposed of and respondents are directed to consider the petitioners eligible, as per
CWP No. 3137, 3149, 3355, 4602, 8828, 8459 and 9005 of 2017 -4their confidential result and allow them to participate in the selection process and call them for interview by treating them eligible, in view of the above mentioned judgments.
