Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.221 dated 17.09.2008 under Sections 406, 498-A and 120-B IPC registered at Police Station Baldev Nagar, Ambala. Inter alia contends that the petitioner has been falsely implicated in the case in hand on account of being a close relative of husband of the complainant. Learned counsel submits that just a couple of months after the registration of the FIR in question the petitioner had to leave for Italy as his visa was expiring and it was during his stay in Italy, he was declared a Proclaimed Offender. He further submits that the petitioner is ready to surrender before the Court below. Heard.

CRM-M-40705-2020 [ 2 ] years thereafter. In view of the same, no ground is made out to extend the concession of anticipatory bail to the petitioner. Learned counsel for the petitioner, however, submits that he would surrender before the Court below and till such time, he may be protected and the Court below be directed to decide his application for bail within a time bound manner.

Petition stands dismissed accordingly. However, in view of the specific stand taken by the learned counsel for the petitioner, the petitioner is directed to appear & surrender before the Court below within a period of one week from today. On his appearance & surrender, the Court below shall decide his application for bail within one week, in accordance with law. Till his appearance and surrender before the Court below within the stipulated time, no coercive steps shall be taken against him. In case the petitioner fails to surrender within the stipulated time, this order shall be of no avail to him.
