MANJARI NEHRU KAUL, J. (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.0020 dated 13.10.2021 under Sections 406, 498-A, 494 IPC registered at Police Station Women, District Ludhiana Rural. Learned counsel for the petitioner submits that in compliance of order dated 16.11.2021 the petitioner had joined investigation and cooperated with the investigating agency. Therefore, the present petition be allowed.
Learned counsel for the State, on instructions from ASI Jaswinder Singh, submits that no doubt the petitioner had joined investigation, however, recovery of 04 tolas of gold and some furniture RUPINDER KAUR 2022.02.24 09:55 I attest to the accuracy and integrity of this document
CRM-M-44979-2021 [ 2 ] which was given at the time of the marriage to the complainant has not yet been effected.
Learned counsel for the petitioner has, however, disputed the factum of the petitioner being in possession of 04 tolas of gold as well as furniture.
I have heard the learned counsel and perused the record. Mere non-recovery of some disputed dowry items cannot by itself be a ground for denial of bail particularly when the petitioner has joined investigation and got recovered substantial dowry, as submitted by the learned State counsel on instructions.
In view of the above, the instant petition is allowed and order dated 16.11.2021 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
