The prayer made in the present petition is for directing the respondents to grant interest to the petitioner to the delayed payment of his retiral benefits.

Learned counsel would contend that the petitioner retired on 30.11.2018, however his retiral benefits were not released on account of a pending charge-sheet dated 26.09.2017, which though had culminated in an inquiry report dated 27.09.2018, Annexure P-3, wherein the allegations against him were found not proved but the proceedings were dropped vide order dated 13.12.2023, Annexure P-5. The retiral benefits have been released after 5 years as indicated in para 14 of the petition and para 9 of the legal notice dated 08.04.2024, Annexure P-8, which was served upon the respondents, however the same has yet not evoked any response. He thus, at this stage, on instructions, from the petitioner, prays that a direction is given be given to the respondents to decide the same in a time bound manner. 3.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 08.04.2024, Annexure P-8, expeditiously which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
