MANJARI NEHRU KAUL, J. (ORAL) The petitioners are seeking quashing of order dated 28.01.2021 (Annexure P-1) passed by the trial Court vide which their bail has been cancelled and non-bailable warrant of arrests have been issued against them in case CIS No.CHI/16/2017 titled as 'State Versus Dalip etc.'.

Learned counsel for the petitioners submits that multiple FIRs have been registered against the petitioners at various places. It has been further submitted that they were arrested from Lucknow on 04.12.2016 and thereafter, were confined in various jails of Jaipur, Alwar, Rohtak and Kurukshetra from 04.12.2016 to 26.10.2020. He submits that it was thus, for a genuine reason that the petitioners were unable to put in an appearance before the Court. At the outset, learned counsel for the petitioners submits that they are ready to appear and surrender before the trial Court, and therefore, they be protected till then.

I have heard learned counsel for the parties and perused the relevant material on record.

In view of the limited prayer made by the learned counsel for the petitioners, the petition is disposed of with direction to the petitioners to appear and surrender before the trial Court within one week from today and move appropriate application for grant of bail. Till then, no coercive steps shall be taken against the petitioners. The trial Court, on such application being moved, shall decide it expeditiously, in accordance with the provisions of law. However, it is made clear that in case the petitioners fail to surrender before the Court below within the above stipulated time period, this order shall be of no avail to them, thereafter.
