CWP 3181 of 2017 Date of decision: 21.2.2017 M/S Sharma Filling Station Petitioner vs.

Indian Oil corporation Limited and anr Respondent

Present:

Mr. IK Mehta, Sr. Advocate with Mr. RK Dogra, Advocate.

M.M.S.BEDI,J.

The petitioner had been advised to upload necessary details/ documents pertaining to the dealership on the Indian Oil Corporation's website vide Annexure P-10.

The grievance of the petitioner is that an unreasonable condition has been imposed that in case the valid documents are not submitted by 14.2.2017, the supplies of all the products will be stopped by the Indian Oil Corporation.

Mr. Ashish Kappor, Advocate for the Caveator informs that till date the supply has not been stopped.

In view of the above circumstances, I deem it appropriate to dispose of this petition as pre-mature observing that no legal enforceable right has accrued to the petitioner to challenge any illegal action of the respondents. However, in the interest of justice, a direction is issued that in case of non compliance of the documents pursuant to Annexure P-10, any decision taken for stopping the supplies will not be implemented for a period of 30 days after the communication of the order to the petitioner, in order to enable him to avail the legal remedy, if any.
