***** Rajan Gupta, J. (Oral) Petitioner was an applicant for the post of Constable in B.C. Category. During the selection test, he had to undergo a mandatory physical measurement test. His height turned out to be 5'-11.75", and marks were allotted to him accordingly. He further raised a grievance by way of present petition that measurement had not been done correctly resulting in denial of one mark to him.

Reply has already been filed on behalf of the State. According to the same, measurement was carried out again by the Civil Surgeon, Fatehgarh Sahib by constituting a board of two expert doctors. In the measurement carried out again, his height was found to be 5'-11.8". was carried out in Government Multi-Speciality Hospital, Sector 16, Chandigarh. However, no difference was found in the height of the petitioner.

In view of the above, it is evident that petitioner cannot be granted more marks for his height. He being below the cut-off percentage is not entitled to appointment to the aforesaid post. Petition is, thus, without any merit and is hereby dismissed.
