( 2 ) CRM-M-41383-2020 (O&M) 3.

The learned Senior counsel representing the petitioner has submitted that his client is willing to deposit the aforesaid amount before the Trial Court and that in case the compromise materializes, the same may be released to the complainant.

4.

The learned State counsel has, however, submitted that since the petitioner is involved in 3 other identical cases, he does not deserve any concession from this Court of any sort.

5.

I have considered rival submissions addressed before this Court. 6.

Since the matter can effectively be resolved amicably wherein the petitioner is willing to compensate the complainant, the petition is disposed of with a direction that in case the petitioner deposits an amount of `10 lakhs before the Trial Court within a period of 10 days from today, he shall be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. It is further directed that in case the parties enter into a compromise for the purpose of quashing the FIR, the complainant would be at liberty to get the aforesaid amount released in his favour. It is further made clear that if the aforesaid payment is not made within a period of 10 days from today, the petitioner shall not be released on bail.

The aforesaid amount shall be released to the complainant only at the time of making a statement in petitioner's favour for the purpose of quashing of FIR. 15.12.2020 ( Gurvinder Singh Gill ) pankaj Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No PANKAJ KAKKAR 2020.12.
