Prayer in the present petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS'), is for grant of anticipatory bail to the petitioner, in case FIR No. 0051 dated 05.4.2025, under Sections 406, 498-A, 506 and 120-B IPC, registered at Police Station Mehatpur, District Jalandhar Rural (Pb.).

Vide order dated 07.7.2025, the petitioner was directed to join investigation. The said order is reproduced hereinafter:- "x x x x Learned counsel for the petitioner, inter alia, submits that the petitioner, who is husband of the complainant, is innocent and has been falsely implicated in the present case. He submits that the marriage between the petitioner and complainant was solemnized on 11.03.2018. The complainant is a quarrelsome lady and she lodged the complaint against six persons i.e. petitioner herein, his parents, two sisters and brother-in-law, however, during investigation, his brother-in-law namely Gurpreet Singh and sister

-2namely Amandeep Kaur have been found innocent. Second sister and mother of the petitioner have already been granted anticipatory bail whereas father of the petitioner has been enlarged on regular bail. He is not involved in any other case and is ready to join the investigation. He further submits that the petitioner is ready to settle the dispute.

Notice of motion.

Mr. Adhiraj Singh, A.A.G., Punjab accepts notice on behalf of the respondent-State and seeks time to file status report. Mr. Narinder S. Lucky, Advocate has put in appearance on behalf of the complainant and undertakes to file his power of attorney in the Registry before the next date of hearing. During the course of hearing, learned counsel for the parties submit that the matter may be referred to the Mediation and Conciliation Center of this Court as there is possibility of amicable settlement between the parties.

The request is accepted and the parties are directed to appear before the Mediation and Conciliation Center of this Court on 14.07.2025 and on the said date, the petitioner shall give Rs.25,000/- to the complainant as litigation expenses. Adjourned to 15.10.2025 to await the report of the Mediator. In the meanwhile, arrest of the petitioner shall remain stayed. He shall join the investigation and co-operate with the investigating agency and shall not leave country without prior permission of this Court."

As per the report 26.9.2025 received from the Mediator, the matter could not be amicably settled between the parties. 4.

Learned State counsel on instructions from ASI Puran Singh, submits that in compliance of order dated 07.7.2025, the petitioner has joined the investigation and is not required for any further investigation. 5.

Having considered the aforesaid facts and circumstances, the petition is allowed. Order dated 07.7.2025 passed by this Court, is hereby made absolute, subject to the condition enumerated under Section 482(2) BNSS.

This order should not be treated as "blanket" order. It will not be read as granting the petitioner(s) indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 7.

Liberty is reserved with the investigating agency/complainant to move to this Court for a direction under Section 483(3) of BNSS, 2023 (erstwhile Section 439(2) of Cr.P.C.), in the event of violation of any term, stipulated under Section 482(2) BNSS, or upon showing any other sufficient cause.

Pending miscellaneous application(s), if any, also stands disposed of.
