C.W.P. No. 9155 of 2016

IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

CWP No.9155-2016 (O&M) Date of decision: 09.09.2025 Gurmeet Singh and others .... Petitioners Vs.

Presiding Officer, Labour Court Ludhiana and others .... Respondents

CORAM:

HON'BLE MR. JUSTICE KULDEEP TIWARI

Present:

Mr. Rajiv Kawatra, Advocate, for the petitioners. Mr. Sumit Jain, Advocate, for respondents No.1 and 2. KULDEEP TIWARI, J (Oral) 1.

Through the instant petition, a challenge is thrown to the six Awards dated 18.02.2016 (Annexure P-5) collectively. It is not disputed that six different references were decided separately by the learned Industrial Tribunal, Ludhiana, qua six different workmen. Therefore, a co-ordinate Bench of this Court, vide order dated 13.12.2023, passed the hereinafter extracted order: "Learned counsel for the petitioner seeks an accommodation to cite law in support of the fact that separate awards in respect of separate petitioners can be challenged by way of a common writ petition." 2.

Today, learned counsel for the petitioners is unable to point out any law that all the six workmen can maintain a single petition. 3.

Considering the fact that the petitioners are poor workmen, this Court is of the view that they can be granted liberty to file fresh petition, on the same cause of action, though, the instant petition was filed way back in the year 2016. The respondent-management cannot possibly have any objection in this regard.

4.

Consequently, the instant petition is dismissed as withdrawn with the liberty aforesaid.
