This is a third attempt of the petitioner to get regular bail, pending trial, in a criminal case FIR No. 13 dated 16.01.2019, registered at under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as "the 1985 Act"), at Police Station Bhogpur, District Jalandhar.

As per the case of the prosecution, the petitioner was found in the conscious possession of 850 intoxicating tablets, containing prohibited substance as per the 1985 Act. The recovered quantity falls in the commercial category.

The learned counsel representing the petitioner contends that the petitioner is in custody since two years and 10 months and he is not involved in any other case under the 1985 Act. DEEPAK KUMAR BHARDWAJ 2021.11.29 14:26 I attest to the accuracy and integrity of this document 4.

On the other hand, Mr. Nikhil Chopra, Additional Advocate

Criminal Misc. No. M-40870 of 2020 General, Punjab, has informed the Court that the statement of the four prosecution witnesses have already been recorded and now the case is listed on 01.12.2021 for recording the statement of the remaining prosecution witnesses.

Keeping in view the aforesaid facts, it is considered appropriate to direct the trial Court to conclude the trial, positively, within a period of three months, from today. The State of Punjab has been impressed upon to ensure the availability of the prosecution witnesses, as and when, required by the trial Court. The Senior Superintendent of Police (Rural), Jalandhar is directed to ensure the presence of all the prosecution witnesses. 6.

With the observations made above, the present petition stands disposed of.
