RAJESH BHARDWAJ, J.(ORAL) Instant writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of writ in the nature of certiorari for quashing the impugned order dated 07.07.2021, Annexure P-8. It is further prayed to stay the operation of impugned order dated 07.07.2021, Annexure P-8, passed by learned Assistant Collector 1st Grade, Teh.Bahadurgarh, District Jhajjar, during pendency of the present petition. Notice of motion to official respondents only at this stage. On asking of the Court, Ms.Upasana Dhawan, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondents/State and submits that petitioner has an alternative remedy of approaching the learned Divisional Commissioner in view of the amendment dated 10.04.2017 under Section 16(1) of Haryana Land Revenue Act, 2017.
In view of the statement made by learned State counsel, learned counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to the petitioner to avail his remedy of approaching the MEENU 2023.10.
CWP-17499-2023 -2learned Divisional Commissioner in view of the above-mentioned amendment.
Allowed as prayed for.
Petition is dismissed as withdrawn with liberty aforesaid. However, it is directed that in case the petitioner approaches the Divisional Commissioner by way of filing an appropriate petition, then the same will be decided by the Divisional Commissioner expeditiously preferably within a period of six months from the date of filing of the same.
