(Oral) In the present petition, the prayer is for releasing of half share of the retrial benefits in favour of the mother of the deceased employee. Learned counsel for respondent No. 6 submits that not only the present petition was filed but in the civil suit filed by respondent No. 6 i.e. the wife of the deceased employee, the said issue has already been finalized that the wife of the deceased employee is entitled for the retrial benefit in preference to the mother which benefit has already been paid to respondent No. 6 i.e. the wife of the deceased employee. No one has appeared on behalf of the petitioner to press the present petition, hence, the present petition stands dismissed for nonprosecution.
