This is second petition for grant of regular bail pending trial in a criminal case arising from FIR No. 188 dated 09.12.2018, registered under Section 22/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the 1985 Act"), at Police station Badhnikalan, Moga.
As per the case of the prosecution, 960 intoxicated tablets of Alprawin 0.5 were recovered from the conscious possession of the petitioner.
In compliance to the order dated 25.09.2020, the Senior Superintendent of Police, Moga has filed an affidavit disclosing that the petitioner is a habitual offender. It has been pointed out that the petitioner has already been convicted in two criminal cases under the 1985 Act, whereas three more are pending. The recovery from the petitioner falls in the category of commercial.
