Present writ petition has been filed to seek higher pay from the date when petitioner assumed the charge of higher post of Junior Engineer. But petitioner has not been given pay for the period he had performed the duties as Junior Engineer and now he has been superannuated. Learned counsel for the petitioner contended that similar controversy has already been decided by this Court in Hardev Singh and Another v. State of Punjab and Others (CWP-13002-2012, decided on 06.12.2012) and State of Punjab and Others v. Hardev Singh and Another (LPA-493-2013, decided on 09.04.2014). Learned counsel further contended that even Special Leave to Appeal No. 13171 of 2015 titled as State of Punjab and Others v. Hardev Singh and Another was dismissed by the Hon'ble Apex Court vide order dated 27.07.2015. Civil Writ Petition No. 28707 of 2018 been decided by this Court vide order dated 09.04.2014 passed in LPA-4932013 and petitioner has already got issued legal notice dated 24.08.2018 (Annexure P9), upon which no decision has been taken so far. Notice of motion.

On asking of the Court, Mrs. Anju Arora, Additional Advocate General, Punjab accepts notice on behalf of the respondents. A complete copy of paper-book be provided to her during the course of the day. In view of above, present writ petition stands disposed of with the directions to the respondents to look into legal notice dated 24.08.2018 (Annexure P9) and take the required decision thereon, expeditiously and preferably within a period of three months from the date of receipt of a certified copy of this order.
