***** JASPAL SINGH, J By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ especially in the nature of mandamus, directing the respondents to fix the retiring pension w.e.f. 01.10.2016 as per relevant Punjab Civil Services Rules Volume II and to pay the said pension along with related entitlement to leave encashment, death-cumretirement gratuity, provident fund along with interest @ 18% from the date the same are due till actual payment as also interest @ 18% per annum on delayed payment of pay due on 30.09.2016 but paid on 04.03.2017. 2.

At the very outset, learned counsel for the petitioner submits that petitioner feels satisfied in case direction is issued to respondent No.1 to deal with and dispose of latest representation dated 17.05.2017 (Annexure P-2), within a stipulated period.

Without expressing any opinion on the merits of the case, the instant petition is disposed of with the direction to respondent No.1-Principal Secretary, Health and Family Welfare, Punjab Mini Secretariat, Sector 9, Chandigarh to consider the case of the petitioner unfolded in representation dated 17.05.2017 (Annexure P-2) and take a conscious decision as per rules and regulations, within a period of 3 months from the date of receipt of certified copy of this order.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, he shall be at liberty to approach this Court as well as to have recourse to the other remedies available to him under law.
