The present appeal pertains to the year 2015 and the same is still at the stage of preliminary hearing inasmuch as notice of motion is yet to be issued. On 09.11.2022 the following order was passed : 'Learned counsel states that despite number of communications to the appellant, copy of the disability certificate has not been supplied to him and further that the appellant has taken back the file from him in January, 2022.

None else appears on behalf of the appellant. Issue notice to the appellant for 06.07.2023, to ensure representation failing which, appropriate orders shall follow, in accordance with law'.

As per the Office report, the sole appellant stands duly served, however, none has put in appearance on his behalf despite service. It appears that the appellant is not interested in pursuing the present appeal. 3.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 4.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
