Grievance of the petitioner is that he was granted pay in the year 1996 and after 22 years, respondents are going to effect the recovery without any basis, though petitioner retired from services on 31.10.2015 and thereafter, he got extension for a period of one year and retired on 31.10.2016. Now his gratuity payment has been withheld on account of such recovery which has been ordered to revise the order of pay fixation of 1996.

Learned counsel for the petitioner placed reliance upon the judgment rendered by the Hon'ble Apex Court in State of Punjab & Others v. Rafiq Masih 2015(1)S.C.T. 195. Learned counsel contended that petitioner got issued legal notice dated 02.09.2018 (Annexure P25) for redressal of his grievance and he would be satisfied if the said notice is decided within a stipulated time frame.
