(ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.604 dated 23.08.2020 registered under Sections 376AB, 294 and 506 IPC and Section 6 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Sadar Hisar, District Hisar. Learned counsel for the State has filed custody certificate dated 16.08.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 02 years, 01 month and 19 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.
