(Oral) Learned counsel for the petitioner contends that while issuing All India Tourist Permit, sitting capacity and standing capacity of the bus were wrongly recorded as 25 and 24 respectively. Infact, it was 21 seats towards sitting capacity and 18 seats towards slipper capacity besides one seat for driver and one seat for conductor.

The aforesaid permit was issued to the petitioner on 31.03.2021. On noticing the aforesaid anomaly, the petitioner represented before the Regional Transport Officer, Rewari on 15.04.2021, but no action was taken. Ultimately, the petitioner filed a detailed representation-cum-legal notice on 08.08.2022, but the same has also not been adverted to till date. CWP No. 21610 of 2022 -2The prayer of the petitioner in respect of making necessary changes in sitting capacity in the permit remained unattended throughout by the respondent- department. Learned counsel for the petitioner submits that at this stage, the petitioner would be satisfied in case his representation-cum-legal notice dated 08.08.2022 is ordered to be decided by respondent No.2 at the earliest in accordance with law.

Notice of motion.

On the asking of the Court, Mr. Sumit Gupta, Addl. A.G., Haryana accepts notice on behalf of the respondents and submits that the needful in the context of deciding the representation-cum-legal notice dated 08.08.2022 shall be done by respondent No.2 in accordance with law within a period of one month from today.

In view of statement made by learned State counsel, this writ petition is disposed of.
