Status report by way of an affidavit of DSP, City I, Bathinda, filed on behalf of respondent-State in Court today, is taken on record subject to all just exceptions.

Main case The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner in case FIR No.134 dated 14.07.2023 under Section 21(c) of NDPS Act and Section 29 of Arms Act registered at Police Station Canal Colony, District Bathinda.

On the last date of hearing i.e. on 06.08.2024, while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation: "Learned counsel for the petitioner inter alia contends SONIA BURA 2024.09.20 10:49 I attest to the accuracy and integrity of this document

CRM-M-37931-2024 -2that the petitioner has been named in the disclosure statement of his co-accused. Other than that there is no corroborative additional evidence available against him." 3.

Learned counsel for the petitioner submits that in compliance of order dated 06.08.2024, petitioner has joined the investigation and cooperated with the investigating officer. Learned counsel for the petitioner has further submitted that although the petitioner is involved in a criminal case registered under Indian Penal Code, however, he has no involvement in any other case under the NDPS Act.

Learned State counsel, on instructions, has not disputed the submission made by learned counsel for the petitioner. Learned State counsel has further submitted that the petitioner is not required for custodial interrogation.

In view of the above, present petition is allowed and interim order dated 06.08.2024 is made absolute subject to the conditions as envisaged in Section 438(2) Cr.PC/482 of BNSS, 2023. (MANJARI NEHRU KAUL) 19.09.2024 JUDGE sonia Whether speaking/reasoned:
