This case has been taken up through video conferencing in the National Lok Adalat in the light of Covid-19 pandemic. It has been submitted by learned counsel for the parties that the matter has been amicably settled between the parties. In FAO No.1703-2015, the insurance company has offered to pay Rs.10,000/-, over and above the amount awarded by learned Tribunal, in full and final settlement of claim in the appeal and this offer has been accepted by the appellant-claimant. In view of this amicable settlement, the Insurance Company is directed to deposit amount of Rs.10,000/-, over and above the amount, so awarded by the Tribunal, before the Lok Adalat Branch of the High Court, within a period VINEET GULATI 2021.09.17 10:06 I attest to the accuracy and authenticity of this document Chandigarh

FAO No.1155-2015 and connected case -2of four weeks, which shall be payable to the appellant-claimant. In the eventuality of Insurance Company not depositing the amount, in the given period, then Insurance Company shall be liable to pay penal interest @ 9% per annum from today onwards, on the above stated amount.

In view of the above settlement, learned counsel for the Insurance Company submits that he does not want to pursue with FAO No.1155-2015, which may be dismissed as withdrawn. Ordered accordingly. Accordingly, FAO No.1155-2015, stands dismissed as withdrawn, whereas FAO No.1703-2015 filed by the appellant-claimant, stands disposed of in above-said terms.

Photocopy of this order be placed on the file of the connected case and a copy of this order be supplied to the counsel/parties and file be returned to the High Court.
