Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Jatinder Singh alias Luddi in case FIR No. 75 dated 08.06.2016, registered under Section(s) 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Sadar Kapurthala, District Kapurthala.

Learned counsel for the petitioner contended that earlier, petitioner was admitted to regular bail and his bail was cancelled on 24.07.2019. On that date, he was confined in jail as is evident from the custody certificate (Annexure P3) and, therefore, he could not appear before the learned trial Court. Otherwise, there was no reason for him not to appear before the learned trial Court and still he is ready to appear and face trial in the case.

Criminal Misc. No. M-35534 of 2019 General, Punjab accepts notice on behalf of the respondent. A copy of paper-book be provided to her during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to regular bail, the learned trial Judge shall decide the same within a period of one week thereafter.
