AMIT RAWAL J. (Oral) Prayer in present writ petition is for issuance of a writ in the nature of mandamus directing respondents to consider the case of petitioner for promotion to the post of Sub Inspector w.e.f. 16.03.2011 as per order dated 25.09.2018 (Annexure P-14), or with effect from the date when his juniors have been promoted and to grant him all consequential benefits. Notice of motion.

On asking of Court, Mr.R.K.Doon, Assistant Advocate General, Haryana, who is present in Court, accepts notice on behalf of respondents-State.

Mr.Surender Lamba, learned counsel appearing on behalf of petitioner submits that petitioner, at this stage, would be satisfied if a direction is issued to respondent No.2 to consider and decide legal notice dated 02.05.2019 (Annexure P-15) within some specified time. CWP No.23124 of 2019 {2} In order to have the decision on grievance of the petitioner, I deem it appropriate to dispose of writ petition without commenting upon merits of the matter with a direction to respondent 2 to decide legal notice dated 02.05.2019 (Annexure P-15) wherein petitioner has raised grievance particularly with regard to promotion to the post of Sub Inspector from the date of his eligibility after 16.03.2011 despite the fact that he had already been exenorated of certain charges by passing a well reasoned and speaking order within a period of two months from the date of receipt of certified copy of this order.

In case, representation is not decided within aforementioned specified time, there shall be costs of Rs.25,000/- to be paid by the concerned officer to the petitioner.
