**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 135 dated 16.9.2020 under Section 306 IPC registered at Police Station Sadar Faridkot.

Custody certificate by way of affidavit of Deputy Superintendent, Central Prison, Faridkot has been filed through e-mail. Copy of the same is taken on record.

Learned counsel for the petitioner submits that in the present case, NK Gora Singh had committed suicide on 13.2.2020 by hanging while he was posted in Indian Army at Bhinnaguri Military Station, West Bengal and there is no suicide note left by him. He further submits that the deceased had a relationship with co-accused Ramanpreet Kaur, who was granted anticipatory bail by this Court on 05.11.2020 and the marriage of the deceased was fixed for 16.2.2020 with one Gurwinder Kaur. CRM-M No. 42178 of 2020 -2counsel further submits that the allegation against the petitioner is that she demanded money from the deceased on phone and also threatened him. He further submits that the petitioner has been in custody for the last 02 months and 22 days.

On the other hand, learned State counsel submits that the petitioner is the President of Mahila Mandal and she demanded money from the deceased and also threatened him that she would call media and insult him at the time of his wedding.

I have heard the learned counsel for the parties. In the present case, NK Gora Singh committed suicide while he was on duty in West Bengal and his marriage was fixed with one Gurwinder Kaur for 16.2.2020. The allegation against the petitioner is that she demanded money from the deceased on phone. As per the custody certificate, the petitioner has been in custody for the last 02 months and 22 days. Co-accused Ramanpreet Kaur has been granted interim bail by this Court vide order dated 05.11.2020. The trial will take time to conclude because of Covid-19 pandemic. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on her furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
