By this common judgment, the aforementioned three appeals arising out of the same award dated 26.02.2013 passed by the learned Motor SONIKA 2026.04.24 10:29 I attest to the accuracy and authenticity of this document
FAO-3415-2013 (O&M) and --2-- other connected cases Accident Claims Tribunal, Faridabad (for short, "the Tribunal"), are being decided. Appeal bearing FAO-3415-2013 has been preferred by the claimant/appellant seeking enhancement of compensation, whereas the other two appeals bearing FAO Nos.3969 & 3970-2013 have been filed by the owner/driver of the offending vehicle challenging the award passed by the learned Tribunal.

During the pendency of the present appeal(s), with the intervention of respected counsel for the parties, a settlement has been arrived at, as per which the respondent-Insurance Company shall deposit an additional amount of compensation to the tune of Rs.25,000/- in favour of the claimant-injured, besides, it shall forgo the recovery rights against the owner-driver.

Learned counsel representing the respondent-Insurance Company, on instructions, submits that an additional sum of Rs.25,000/- shall be deposited with the Daily Lok Adalat Branch within four weeks from today and thereupon, the said amount be transmitted to the claimant/injured. In case the needful is not done within the stipulated time, the respondent-Insurance Company shall be liable to pay additional interest at the rate of 9% per annum from the date of expiry of the said period till the date of payment of the aforesaid amount.

Accordingly, the aforementioned appeal(s) stand disposed of. 5.
Pending miscellaneous application(s), if any, shall also stand disposed of.
