The present civil revision has been filed under Article 227 of the Constitution of India for quashing of the impugned order dated 07.05.2026 (Annexure P-6) passed by the Court of learned Civil Judge (Junior Division), Samrala, whereby, the learned trial Court has dismissed the application for interim temporary injunction at this stage without considering the factual position of the case.

Learned counsel for the petitioners inter alia contends that the petitioners have filed a civil suit along with an application under Order 39 Rule 1 and 2 of CPC seeking grant of ad interim temporary injunction. However, the learned trial Court declined the prayer for ex parte ad interim injunction and issued notice of the civil suit as well as the stay application to the defendants. He further submits that since the application for temporary injunction is still pending consideration, the petitioners have no efficacious remedy except to approach this Court for issuance of appropriate directions. The learned trial Court has not decided the stay application despite the fact that it was initially listed for 20.05.2026 and is now stated to be listed for 27.07.2026. Learned counsel for the petitioner wishes to withdraw the present petition at this stage, however, he confines his prayer to the extent that the learned trial Court be directed to decide the stay application expeditiously, by preponing the case from 27.07.2026.

In view of the limited prayer made by learned counsel for the petitioner, the present petition is disposed of with a direction to the learned Civil Judge (Junior Division), Samrala, to decide the stay application filed by the petitioner seeking ad interim temporary injunction on or before the next date of hearing, i.e. 27.07.2026.
