CM-6790-CII-2014 Heard. There is delay of 316 days in filing the appeal. Learned counsel for the appellant submits that after his statement before the tribunal, the appellant could not contact his counsel to know the final decision of the case and came to know about the impugned award only in March, 2014 when he received the summons from this court in FAO No.2668 of 2016 and in XOBJC-116-CII of 2013. He immediately approached the counsel and filed the appeal, resulting in delay of 316 days in filing the appeal.

In view of the submissions of learned counsel for the appellant and facts mentioned in the application, the same is allowed and delay of 316 days in filing the appeal is, hereby, condoned. FAO-1915-2014 For orders, see (FAO No.2668 of 2013 Dayanand and others Vs. Narender and others).
