On 22.12.2021 the appeal was ordered to be heard with FAO-3501-2021. On 21.01.2022, though none had appeared on behalf of the appellant, however, on request of learned counsel for the appellant on account of his being unwell, an adjournment was granted. Yet again on 28.02.2022 an adjournment had been sought on the ground that counsel was in personal difficulty. Today again a request for an adjournment has been made on behalf of learned counsel for the appellant on the ground that his instructions are incomplete.
Adjourned sine die with liberty to move an application for taking up the matter for hearing when the counsel for the appellant is ready to argue the matter." JITENDER KUMAR 2024.02.12 10:44 I attest to the accuracy and integrity of this order/judgment Chandigarh
FAO No.3438 of 2021 -2- 2024:PHHC:018773 2.
Since 26.04.2022 no effort was made by the counsel for the appellant to file any application for getting the case listed for hearing and hence the matter has now been listed before the Court today for hearing. However, today, an adjournment slip has been circulated on behalf of arguing counsel for the appellant on the ground that he is unwell. 3.
As per e-Court website of District Court Moga the matter was put up before the Lok Adalat where the statements of the parties were recorded regarding the compromise and in view of their statements the execution petition stands dismissed as withdrawn before the Lok Adalat vide order dated 11.02.2023 since the entire amount stands paid as per the settlement.
4.
In view of the order passed by the Lok Adalat, the present appeal has been rendered infructuous and the same is dismissed as such. However, since learned proxy counsel appearing on behalf of the appellant states that he has no instructions in the matter, liberty is granted to the appellant to get the present appeal revived in case any anything survives therein. Pending applications, if any, also stand disposed off.
