The challenge in this writ petition is to the sale notice dated 03.05.2016 (Annexure P-6) whereby the stored paddy and rice belonging to the petitioner has been put to sale for 17.05.2016. 2.

After arguing for some time, learned counsel for the petitioner submitted that he may be allowed to withdraw the instant petition, with liberty to the petitioner to avail the alternative remedy of appeal before the Tribunal, under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI).

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies, as may be available to it, in accordance with law.
