The petitioner has approached this Court under Article 226 of the Constitution of India, seeking a writ of Mandamus directing respondent No. 1 to take over the physical possession of the mortgaged property i.e. Hotel KC Cross, Sector-10, Panchkula mortgaged by M/s Walia Traders Limited, Chandigarh, under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

Learned counsel for the petitioners submitted that inadvertently, certain necessary factual matrix has not been incorporated and relevant documents have also not been appended with this writ petition. Accordingly, a prayer has been made that he may be allowed to withdraw the present writ petition, with liberty to file fresh one on the same cause of action by furnishing fully complete and comprehensive particulars. 3.
