Jaswant Singh,J(Oral) Petitioner-Narinder Kaur, is an aspirant for appointment as Anganwari Worker on compassionate basis in Village Goslan, Tehsil and District Ropar, on account of death of her mother-in-law who was previously engaged as an Anganwari Worker in the said Village, as the same is sought to be filled up through advertisement dated 4.5.2016(P-7). In the present writ petition challenge is to the advertisement P7 as also to the order dated 4.4.2016(P-6) whereby her claim for compassionate appointment has been declined vide speaking order. Counsel for the petitioner heard at length.

A perusal of the impugned order P-6 itself reveals that the petitioner alongwith her father-in-law, herself has written to the authorities that none of the family members is covered as per instructions issued by the Government for appointment as Anganwari Worker and therefore, request for filling up the post after making due publicity. CWP 9517/2016 advertisement that is precisely sought to be done. No instructions have been shown which entitles the petitioner to seek employment on compassionate basis for the post of Anganwari Worker which is sanctioned under a scheme.

Facts taken cumulatively, no case for interference is warranted. Dismissed with costs of Rs.5000/- (Rupees Five thousand only) to be deposited with District Legal Service Authority,Ropar within three months from today,failing which, Member Secretary, District Legal Service Authority,Ropar shall take steps to recover the costs as arrears of land revenue.
