(ORAL) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular to the petitioner in case FIR No. 27 dated 08.03.2019 (Annexure P-1) registered under Sections 376, 344, 506 and 120-B IPC at Police Station Mehtiana, District Hoshiarpur. Learned counsel for the State has filed custody certificate dated 21.08.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 02 months and 17 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.
