Petitioner seeks quashing of order dated 30.04.2026 of learned Judge, Special Court, Ferozepur vide which non-bailable warrants were issued against him in FIR No.229 dated 16.08.2025 under Sections 21/61/85 of Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, Police Station Sadar Ferozepur, Punjab.

Learned counsel for the petitioner submits that petitioner who was facing trial in above-mentioned FIR was allowed regular bail by learned Judge, Special Court, Ferozepur on 25.09.2025. After presentation of challan, when petitioner failed to put in appearance, learned Judge, Special Court, Ferozepur cancelled his bail and summoned him through non-bailable warrants of arrest for 30.05.2026. Learned counsel further submits that petitioner could not present himself before the Court on account of wrong noting of date and was ready to surrender in the Court but was fearful on account of non-bailable warrants of arrest and some protection may be granted.

Mr. Kunwarbir Singh, AAG Punjab accepts notice on behalf of respondent State and opposes the prayer of the petitioner. 5.
Petitioner was released on regular bail in the aforementioned FIR vide order dated 25.09.2025. Perusal of impugned order reflects that bail of the petitioner and his bonds have been cancelled and forfeited to the State. Since, petitioner bonafidely intends to join the proceedings and face trial, he must be permitted to do so. Petitioner is accordingly directed to put in appearance before learned Judge, Special Court, Ferozepur within 10 days from today and move requisite application for bail which shall be decided the same day. Till then, non-bailable warrants of arrest of the petitioner shall remain in abeyance.

The petition stands disposed of, on the above terms. 7.
