Jaswant Singh,J(Oral) Petitioner was working as a Patwari and attained the age of superannuation (58 years) on 30.11.2015. On his request vide order dated 28.8.2015 (P-1) he was granted one year's extension in service till 30.11.2016.

As he was, concededly, facing criminal trial in FIR No.167 dated 29.9.2009 for offences under Sections 420,467,468,471,120B,201,207 and 208 IPC for participating in sanctioning a false mutation, his extended period was cut short vide order dated 26.4.2016 (P-4) and he was subsequently relieved from his duties.

Prayer in the present petition is for issuance of a mandamus directing the respondents to reinstate the petitioner as Kanungo in view of the extension granted.

After arguing for sometime,learned counsel seeks permission to withdraw the writ petition.

Dismissed as withdrawn.
