* * * AWARD OF LOK ADALAT BENCH NO.5 After detailed discussions and deliberations, learned counsel for the parties have submitted a proposal to settle the matter. The appeal was filed by the Insurance Company challenging the award of compensation by the learned Tribunal but the learned counsel for the Insurance Company has the instructions to settle the amount at Rs.60,000/- (Rupees Sixty Thousand Only) over and above the amount already awarded by the learned Tribunal. Accordingly, this award is made with the direction to the Insurance Company to deposit the enhanced amount of Rs.60,000/- (Rupees Sixty Thousand Only) by cheque/draft, in favour of respondent No.1-Subhashclaimant/cross-objector with the with the office of the Lok Adalat on or before 21.12.2024. Failing compliance of the order, interest @ 9% per annum shall follow on this amount till payment from the date of this order. In view of the aforesaid settlement, enhanced amount of compensation is awarded to the respondent/claimant/cross-objector. The cross objections stands allowed.

XOBJC-157-CII-2015 disposed of.

In view of the above, the FAO-1325-2015 filed by the Insurance Company is rendered infructuous.

The statutory amount of Rs.25,000/- deposited at the time of filing of the appeal be refunded to the Insurance Company. Copy of this order be supplied/sent to the counsel/parties and file be consigned to the record room.
