The petitioner is seeking the concession of anticipatory bail under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case bearing FIR No.209 dated 23.07.2023, registered for the offences punishable under Sections 406, 420 and 120-B of the IPC and under Section 13 of the Punjab Prevention of Human Smuggling Act, at Police Station City Rajpura, District Patiala.

On 11.08.2023, while noticing the following submissions made by the learned counsel for the petitioner, a Coordinate Bench of this Court had granted the concession of interim bail to the petitioner and asked her to join investigation:- "Learned counsel for the petitioner(s) submitted that both the petitioners are ladies and the dispute is only a money dispute. Learned counsel for the petitioner submits that in compliance of order dated 11.08.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Reply filed by the learned counsel for the respondentcomplainant in Court today is taken on record. 5.

Learned State counsel, on instructions from SI Satnam Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for her custodial interrogation.

In view of the above, the petition is allowed and interim order dated 11.08.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
